Below is the Maine state statute which controls the amount of money that doctors, hospitals, and other health care providers can charge for copies of medical records provided to the patient or the patient’s attorney for use in personal injury or wrongful death civil cases. Note that there may be other statutes which pertain to workers’ compensation claims, Social Security disability matters, etc.

One type of revision which is especially hard for us to keep track of has to do with cost changes allowed annually by a statute and based on some indexed inflation rate.

Maine
Title 22 Section 1711
- $5 for the first page
- $0.45 for additional pages
- Up to a maximum of $250 for the entire treatment record or medical report.
Digital (Electronic) Records:
- The health care practitioner may assess as charges reasonable actual costs of staff time to create or copy the treatment record or medical report and the costs of necessary supplies and postage.
- Actual costs may not include a retrieval fee or the costs of new technology, maintenance of the electronic record system, data access or storage infrastructure.
- Charges may not exceed $150.
